Justice rejected the request for house arrest made by Marcos Córdoba, the machinist arrested by the Once tragedy. The defense had asked for the benefit with the argument of the advance of the coronavirus pandemic in Argentina, according to judicial sources reported on Tuesday.
The machinist who led the formation of the Sarmiento Railroad on February 22, 2012, when the crash occurred, had also requested that benefit by stating that he has a daughter of little more than 20 months who lives alone with mom.
For the judge Jorge Gorini the elements presented by the defense of the machinist, arrested in 2018 and sentenced to three years and six months in prison for the crime of guilty havoc, were not enough as to grant him the benefit of house arrest.
The daughter of Córdoba is in the care of his mother who has the support of her in-laws, who live in a house located a short distance away, “which favors the collaboration of the needs that the minor requires,” said the judge.
“In light of the foregoing, it is not possible to determine that M.A.C. (by the initials of the minor) is in a situation of helplessness, given that he receives the care that a minor of his age requires ”, added the magistrate.
In relation to the appearance of the coronavirus as a reason to grant it the benefit, the judge considered that the existence of the pandemic “cannot constitute a significant argument enough to modify the mode of confinement” and stressed that Córdoba is not in the list of people at risk prepared by the Federal Penitentiary Service.
TOF 2 should have been issued after the Federal Chamber of Criminal Cassation ordered that the proposal made by attorney Valeria Corbacho, defender of Córdoba, be re-analyzed, since the previous rejection was before a health emergency was declared.
