The Federal Oral Court (TOF) 5 refused on Monday to grant the benefit of home imprisonment to the repressor Alfredo Astiz, recalling that there were no cases of coronavirus in prisons.
Astiz, 69, is serving two life sentences for crimes against humanity committed during the last prolonged civil-military dictatorship between 1976 and 1983.
The repressor’s lawyers had considered that Astiz needed house arrest because, for his age and for his prostate cancer, he was more at risk against the coronavirus.
Before a first rejection, The repressor’s lawyers invoked as a jurisprudence in their favor a ruling that benefited former Vice President Amado Boudou in the first days of April.
“The mere invocation by the defense of finding its procedural godson within the population at risk cannot constitute a sufficiently important argument to modify the mode of confinement, as its position is maintained on the merely conjectural plane and the materialization is not verified of the risk that justifies, at the moment, accessing the petitioner, “argued the TOF 5 judges.
The judges noted that the authorities of the Federal Penitentiary Service (SPF) implemented protocols and directives with the aim of preventing contagion of coronavirus in prisons.
